Terms and conditions of the Bodymaps Online Store

§1 General Information

 The following terms („Terms”) regulate the use of the online store avaliable at www.bodymaps.pl („Store”).

The Store is run by Ewa Stepnowska leading a business under the name „Bodymaps Ewa Stepnowska” entered into the CEIDG by the Minister of Economy, REGON: 361667658, NIP: 5361919520 („Seller”).

The core business of the Store is retail sales of swimwear („Products”) over the Internet.

The customers of the Store may be individuals with full legal capacity, as well as legal persons and organizational units without legal personality but equipped with legal capacity. All activities related to the use of the Store services can only be carried out on behalf of legal persons and organizational units by persons authorized to represent the entities ("Customer").

To make full use of the services, Store customers should use a data communications system with access to an internet connection and a web browser, accepting cookies and an e-mail address.

Customers are prohibited from unlawful content delivery, that would destabilize the work of the Store, hinder the access to the content or the use of the Store. It is also forbidden to use the Store with other intentions than Store’s original purpose, especially sending spam, running any commercial, advertising or promotional etc. activity on the Store’s website


§2 Orders


1. Client can enter into a sales agreement with the Seller by placing an order via Store. Order can be placed 24 hours a day, seven days a week. Orders placed during the weekend or on holidays will be filled on the first working day after the day it was placed. To place an order it is required to fill the order form on the Store’s website, that contain all the data necessary to ship the order, including Client’s e-mail address.

To place an order it is necessary to go to the „Shop online” section on the www.bodymaps.pl website, then to choose the Products (model, color, size and quantity) from the avaliable offer. All the products are brand new. The photos of the Products are examples and are intended to present a particular model. The Store exercises due diligence to ensure that product images reflect their true color and texture. The colors in the product images may differ slightly from reality.

Client chooses the Product through clicking on the Product chosen from the offer, choosing size and quantity and clicking „Add to Basket” button. After adding chosen Product to the Basket it is possible to continue shopping („Continue shopping” button) or finalize the order („Order” button).

After clicking the „Order” button it is necessary to fill the form containing e-mail address, shipping choice and the payment method and to give consent for the personal data to be processed for the purposes necessary to place an order, and then click the „Next” button. 

After clicking the „Next” button it is necessary to fill the form with the Client’s data and the shipping address. Until rhe order is confirmed by clicking „Order and pay” button Client can change or modify the Products in the order, Client’s personal data and shipping address.

Placing an order by the Client (confirming by clicking the „Order and pay” button) means an offer from the Client to the Seller in order to  make a sales agreement in compliance with the Terms of the Store.

After placing an order, a confirmation will be shown on the Store’s website, and an e-mail will be sent to the e-mail adress listed in the order form. The e-mail will include the information about the ordered Products, the value of the order, chosen shipping option and payment method, Client’s data and the information listed in the art. 12 of the 1. Act of June 24th, 2014 on the consumer rights (Dz. U. z 2014, poz. 827) („the act about consumer rights”).

Client receives a confirmation of accepting his offer via e-mail („Order confirmation”) to the e-mail address listed in the Client’s order form. After receiving the Order confirmation the sales agreement of the Products ordered by the Client is made.

In case of doubt about the form submission relating to the correctness of the form filled out by the Customer (in particular with regard to customer data and shipping address) or in case of any problems with the authorisation of the payment, the Store will get in touch with the Customer in order to receive clarification. In the absence of an explanation from the Customer, the Store can refuse to confirm and execute the contract.

§3 Price and payment methods

Seller reserves the right to change the prices of goods on offer, introducing new products to the offer, organizing promotional activities on the Store Website. 

All prices are expressed in Polish zloty and EURO, and are full, gross (including VAT) prices for the product without  shipping costs included. The shipping costs are added to the final cost of the contract depending on the method of delivery chosen by the Customer. A Customer placing an order is informed about delivery costs, which together make up the value of the contract.

The value of an order indentures the parties from the moment the Client receives an order confirmation. The price mentioned will not change regardless of the change of the Product/s price on the website, if it changes after receiving the order confirmation by the Client.

4. By placing an order client has a right to choose on of the payment methods avaliable, depending on his preferences and sipping option choice. There are various payment methods avaliable:  bank transfer via electronic payment system Przelewy24, direct bank transfer to the bank account of the Seller (mBank, No. 75 1140 2004 0000 3002 7570 4150) or cash payment in case of personal collection. Client should pay the Products value and shipping costs as soon as possible, not later than within 7 days after receiving the order confirmation.



§4 Delivery and collection


1. In case of choosing personal collection as the shipping option, the collection of the Products is possible in Warsaw, Poland, after previous confirmation from the Seller about the time and the place of the collection. In order to fix the date and place of collection the Products it is necessary to contact the Seller by e-mail (studio@bodymaps.pl) or on the phone (+48)515333697.

In case of choosing the express shipping as the shipping method, the Products will be delivered to the shipping address included in the order form by the Client via one of following courier companies: DHL, GLS, X-press Couriers. The Store informs each Customer of the cost of delivery at the time of ordering. The cost of delivery is an additional cost to the price of goods and will be added to it.

In case of choosing standard shipping as the shipping method, the Products are delivered to the shipping address included in the order form by the Client via one of following companies: Poczta Polska, InPost. The Store informs each Customer of the cost of delivery at the time of ordering. The cost of delivery is an additional cost to the price of goods and will be added to it.

The Products are sent within 2 working days from the day of receiving the Order confirmation by the Client, with a reservation, that the order is carried out only after receipt of the price with shipping costs on the Store account.

The Customer should determine the status of the consignment at the time of receipt, and in the case of a trace of the consignment or its seals, closures and walls having been breached or other damage, the Customer should inform the carrier of his reservations and request the preparation of a protocol to determine the status of the shipment. In the event of damage or loss of the consignment, which could not be seen at the stage of receiving the delivery, the Customer should notify to the carrier immediately upon noticing and request preparation of a damage report.

6. The moment of release of the Products is at the time of receipt of the ordered Products form the courier, or in case of presonal collection, the time of receipt of the ordered Products from the Seller.  


§5 Complaints 

The Seller is obligated to deliver undamaged Products. The Seller is responsible for Product damages (warranty) accordong to applicable laws, in particular the provisions of the Act from 23. April 1964 Civil Code (t.j. Dz.U. z 2014, poz. 121 ze zm.) („Civil Law’) and the Law on Consumer Rights.

The Consumer can make a complaint on goods purached in the Store with the time limits and conditions of complaints referred to the relevant laws. Client may make a complaint regarding the contract concluded at e-mail at studio@bodymaps.pl or in writing at the address ul. Ogrodowa 8, 05-126 Nieporęt. The complaint should contain at least the following: name, mailing address and e-mail client, the date of conclusion of the contract giving rise to the complaint, the subject of a complaint indicating customer demand and any circumstances justifying the complaint. If possible, the Customer should attach a proof of purchase - a receipt.

If given any complaint data or information need to be supplemented, the Seller shall reimburse the Client submitting the complaint by supplementing the indicated range before examining the complaints. The Seller shall consider the complaint within 14 days of its receipt in the correct form. The answer to the complaint is sent to an e-mail address specified by the Customer or to a correspondence adress.

The goods that are complained should be packaged safely, so it can’t be damaged on the way to the Seller. In case of a recognized claim, the Seller should cover the shipping costs. 

5, If the Customer is not a consumer within the meaning of Art. 22 [1] of the Civil Code - the Seller’s responsibility for the warranty does not apply.



§6 The right of withdrawal

 Client being a consumer within the meaning of Art. 22 [1] of the Civil Code, which entered into a contract at a distance may withdraw from it within 14 days from the date of delivery of ordered products to the Client without giving any reason.

 In order to use the right of withdrawal, the Client should inform the Seller of his decision to withdraw from the agreement by a unilateral declaration via e-mail at studio@bodymaps.pl or by a letter sent by mail to the address: ul. Ogrodowa 8, 05-126 Nieporęt. In order to make a statement of withdrawal the Customer can use the form set out in § 6 paragraph. 7 of the Terms. Using the withdrawal form is not mandatory.

In case of withdrawing from the contract, the Client should send or deliver the product to the Seller at the address given in paragraph. 2 above, immediately and not later than 14 days from the date on which the Customer has informed the Seller to withdraw from the contract. The deadline is met if the customer returns the product before the expiry of 14 days. The customer bears the direct cost of returning Products.

In case of withdrawing from the contract, the Seller will return all received payment to the Consumer, including the costs of delivery of the Products no later than 14 days from the date on which the seller was told by the Client of his decision on withdrawaling from the contract.

 The refund of the payment will be made using the same payment methods that were used by the Customer when purchasing products, unless the customer clearly agreed on another solution. In each case the Customer does not incur any fees as a result of the refund.

The Seller may withhold the refund until receiving the Product or the time of delivery of the proof of its return, depending on which event occurs first.

§ 7 Final Provisions

1. Terms are available to the Client only in electronic form on the www.bodymaps.pl website. The customer can print the Terms, as well as save the on his own data carrier. 

The administrator and the exclusiv owner of the Store is Ewa Stepnowska, established under the name Bodymaps Ewa Stepnowska based in Nieporęt, address: 05-126 Nieporęt, ul. Ogrodowa 8. Clients' personal data given when ordering in the Store are processed by the store only to carry out orders.

The customer agrees to use the Store according with the provisions of the Terms (the version from the day of the order). Lack of acceptance of the Terms unables to puchase Products offered by the Store.

 Polish law applies to the sales contracts concluded in the Store. 

 The Seller has the right to make changes to the rules to the extent permitted by law, in particular for reasons arising from changes in the law, affecting the provisions of the Terms and for technical reasons.

In cases involving a dispute between the Store and the Customer being a consumer within the meaning of Art. 22 [1] of the Civil Code, arising from sales agreements regulated the Terms, the competent court is the general court resulting from the provisions of the law.

In cases relating to disputes between the Store and the Customer other than that specified in paragraph. 1, resulting from sales contracts regulated by the Terms, the competent court is a court of law competent for the seat of the Seller. 


Regulations come into force on June 29. 2015.
